Best Practices to Ensure All Paid Partnerships Follow Regulatory Guidelines for Fairhaven Health

This outline is to help ensure that YOU (our influencers, experts, and sponsors) with whom we have a material connection (paid partnership) understand the Food and Drug Administration (FDA) and Federal Trade Commission (FTC) regulations with respect to the marketing and promotion of dietary supplements.

We are both responsible to abide by these regulations to avoid any potential enforcement action by either the FDA or FTC. But don’t worry – there is nothing to be concerned about as long as these simple guidelines are followed.

Do we have a material connection? According to the FTC, a material connection applies if you receive any sort of payment including cash, free product, commission from sales, or entry into a sweepstakes or content.

Disclosure Statement Required

  • Your post must comply with the FTC’s guidelines for Social Media Influencers. See guidelines here. If you have any questions, feel free to reach out to partner@fairhavenhealth.com.
  • Tag Fairhaven Health as a Paid Partner and Collaborator on social media (when it applies).
  • Sponsored articles must contain a disclosure statement.
  • Posts, videos, or articles discussing dietary supplement product benefits must include the following FDA statement at the bottom of your post (see below). An asterisk must appear at the end of each sentence that highlights a product benefit.

Marketing Claims or Statements

Marketers of dietary supplements are prohibited from making explicit or implied disease claims or drug claims. As such, statements that suggest a dietary supplement cures, treats or prevents a disease must be avoided.

Specific to Fairhaven Health, we must avoid making claims that our products treat infertility or any other diagnosable medical condition. Additionally, we must avoid using these types of phrases: increase chances of getting pregnant with X, I conceived while taking X, etc.

Instead, content should be focused on how our products, or the ingredients in our products, “support reproductive health and fertility”, including supporting “sperm health”, and “healthy ovulation”, “supports a regular cycle”, etc. Broad statements such as “I really loved this product”, or “I’ve recommended this to friends and family” are perfectly acceptable.

  • Any words ending with “-itis"
  • Natural/All-Natural
  • Pure/100% Pure
  • Fast Acting/Quick

By participating as a Fairhaven Health influencer, you retain the rights to your original content, while granting Fairhaven Health the unrestricted, royalty-free, perpetual right to use, reproduce, communicate, and display the works, in whole or in part, for any purpose, without further compensation and without further notification or permission.

Please note: Fairhaven Health reserves the right to request the removal of published content found to be in violation of any of the guidelines described above.

Failure to comply with FDA and FTC Guidelines may result in immediate termination of our partnership agreement. We reserve the right to request removal of content related to our brand at any time.
